Compliance and Audits in Germany: What Every Amazon Seller Needs to Know
13.08.2025

OUR GOAL
To provide an A-to-Z e-commerce logistics solution that would complete Amazon fulfillment network in the European Union.
Sending your products to an Amazon FBA warehouse in Germany requires more than just putting them in a box. Germany has some of the strictest packaging and product compliance laws in Europe. Failure to meet these requirements can lead to rejected shipments, fines, and even the suspension of your selling privileges.
The German Packaging Act (Verpackungsgesetz - VerpackG)
This is the most critical piece of legislation you must comply with. It affects anyone who sells packaged goods to German end consumers.
- What It Is: The VerpackG makes producers (including online sellers) financially responsible for the recycling of the packaging they put into the market.
- Your Obligations:
- LUCID Registration: You must register your brand and the types of packaging you use (cardboard, plastic, glass, etc.) in the public LUCID registry. This is a legal prerequisite.
- System Participation (Dual System): You must sign a contract with a "dual system" provider (like Der Grüne Punkt) and pay a license fee based on the weight and type of packaging materials you will sell in Germany in a given year.
- Consequences of Non-Compliance: Amazon is legally required to verify that sellers are compliant. If you cannot prove your LUCID registration, Amazon can and will suspend your listings on Amazon.de.
Amazon's Physical Packaging Requirements
Beyond the legal framework, your packaging must meet Amazon's own strict FBA standards.
- "SIOC" (Ships in Own Container): If your product's packaging is sturdy enough to be shipped to the customer without an additional Amazon overbox, it can be certified as SIOC. This reduces waste and can lower your fees. However, the packaging must be robust and pass drop tests.
- Suffocation Warnings: Any poly bags with an opening of more than 5 inches (approx. 12 cm) must have a clearly visible suffocation warning printed on the bag, written in German.
- No Loose Items: Products must be securely packaged. Items sold as a set must be clearly labelled as a set ("Dies ist ein Set. Nicht trennen.").
- Correct Labelling: Every individual unit must have a scannable FNSKU barcode that is easily accessible without opening the product packaging.
How FLEX. Ensures Packaging Compliance
Navigating these dual layers of legal and operational requirements can be complex, especially for non-German sellers.
- Expert FBA Prep: Our prep service ensures that every one of your products is packaged and labelled according to Amazon's latest FBA guidelines, including applying suffocation warnings and set labels.
- Guidance and Support: While we are not legal advisors, we can guide you on the importance of VerpackG compliance and ensure your physical shipments are perfectly prepared.
- Quality Control: We act as your last line of defense, checking your products before they are sent to F-series, helping to prevent costly rejections due to packaging errors.
